When a prospective client contacts us regarding a criminal matter, one of the first questions that they ask is, should I talk to the police?
The answer is simple. If you are facing any possible criminal charges and if the police are attempting to speak with you about incidents involving criminal sexual conduct (rape), drug related crimes, assault and battery, theft or any other possible criminal behavior, you should not say a word unless your attorney is present.
Do I have the right to have an attorney present if I am only suspected of criminal behavior?
Yes, you should immediately tell the police officer that you will not talk to them until you have spoken to an attorney.
What is the difference between a License Suspension and License Revocation?
Driver’s licenses can be suspended or revoked depending on the type of driving infraction that you have been charged with.
- A license suspension means that your driving privileges are suspended for a specified period of time. You may begin driving again if you have paid off your fines, costs, and other fees. During a suspension you may be eligible for restricted driving privileges that would allow you to drive to and from work, school, and medically necessary appointments.
- A license revocation means that your license is completely taken away and you are not allowed any restricted driving privileges. To get your driver’s license back you must go to a hearing before a representative of the Secretary of State and prove that you are no longer a danger to the public.
Remember, driving is a privilege, not a right. It is important that you protect your driving privileges by contacting an attorney immediately.
I have heard that my driver’s license could be suspended for possession of marijuana, even if I was not driving when the police caught me. Is this true?
Yes. Your driver’s license will be suspended for a minimum of six months if you are convicted of any drug related crime. This is true even if your conviction had nothing to do with driving.
