My son is a juvenile and has been charged with a crime. If his case is being handled in Juvenile Court do I need to speak with an attorney?
Yes. You should speak with an attorney so that you and your son understand the possible punishments that he could receive from the Court if he is convicted of a crime. Even juveniles risk detention, suspension of their driver's license, and expensive court costs and fines if they are convicted of a criminal charge.
My child is 17 years old and was just charged with a crime. Why do we have a notice to appear in the adult District Court?
In Michigan, children age 17 and older are treated as adults in the criminal justice system. At age 17, your child risks jail and prison just like adults. Even children under the age of 17 can be charged as adults in certain situations. You should speak with an attorney to protect your child's rights.
I was charged with Minor in Possession of Alcohol. I heard that you cannot be given jail time for this charge. Should I just go to court and plead guilty?
While you cannot receive jail time for an for a first conviction, your conviction will be reported to the Secretary of State and will be placed on your driving record. Further, if you receive a second conviction for MIP, the penalties get worse and will include loss of driving privileges. There may be a defense to your charge that would allow you to have it dismissed, or there may be a way to keep it off your driving record all together. You should speak with an attorney about your case right away.
